The Court of Appeal today ordered the adjournment of the petition filed by former President Gotabaya Rajapaksa seeking the issuance of a writ of injunction preventing his arrest in connection with the investigations being conducted into the Easter Sunday terror attacks until tomorrow (17) afternoon.
The order was made when the petition was taken up before a bench of judges comprising the President of the Court of Appeal, Justice Rohantha Abeysuriya and Priyantha Fernando.
At that time, Judge Priyantha Fernando, a member of the bench, stated in open court that he would not participate in the hearing of the petition due to personal reasons.
President’s Counsel Romesh de Silva, who appeared for the petitioner former President, presented the facts before the court and requested that an interim injunction be issued preventing the arrest of his client.
Deputy Solicitor General Suharshi Herath, appearing for the respondents, informed the court that since the documents related to this case were received by him this morning, no instructions have been received from the respondents so far. Therefore, the court cannot give an undertaking that the petitioner will not be arrested.
