The arrest of Wasantha Mudalige during the struggle is illegal.

The Supreme Court ruled today (19) that the police violated the fundamental human rights of Wasantha Mudalige, the convener of the Inter-University Students’ Federation, under the Prevention of Terrorism Act during the struggle in 2022.

Supreme Court Justice Sobitha Rajakaruna, with the concurrence of Justices Arjuna Obeysekara and Priyantha Fernando, delivered this judgment after hearing a petition filed by Attorney-at-Law Manjula Balasuriya on behalf of Wasantha Mudalige, who was in custody.

Announcing the judgment after a lengthy hearing, the bench noted that the respondents had not presented sufficient grounds to raise reasonable suspicion to detain Wasantha Mudalige, who was arrested during a protest, under the Prevention of Terrorism Act.
