The manner in which Parliament was dissolved was illegal

Social activist Oshala Herath states that the gazette issued to dissolve the existing Parliament and call the General Election is against the Act.

“The President dissolves Parliament in accordance with Section 10 (1) of the Parliamentary Elections Act. Accordingly, arrangements are being made to disperse on September 24 at midnight. In the same gazette announcement, the election is set for November 14. According to section 10 (2) nominations are called within 10 days of dissolution. Accordingly, nominations will be called on October 4.

The next section of the Act states that submission of nominations should be completed by 12 noon 7 days from the date of calling for nominations. Accordingly, the acceptance of nominations was completed at 12 noon on October 11. After that, the Act says that the election should be held on a date not less than 5 weeks and not more than 7 weeks after that date.

November 15 is 5 weeks from October 11. Because of that day, it is allowed to use it on the 16th or later. But now the election date has been announced one day less than the law.

Therefore, if someone goes to court, the gazette has to be cancelled. This is a practical and legal situation.. The lawyers here can correct me if I am wrong.”
