Court Order Restraining Arrest of Ministry of Labour Secretary

The Court of Appeal has issued an injunction today to prevent the arrest of R.P.A. Wimalaweera, the Secretary of the Ministry of Labor and Foreign Employment.

The Horana Magistrate’s Court had previously issued an arrest order for the Ministry Secretary in connection with his actions as the Labor Commissioner. He had informed officials to enforce the law against a particular institution following the tragic demise of six employees at a rubber factory in the Horana region.

In response to the aforementioned order, the Ministry Secretary had lodged a petition with the Appellate Courts seeking a writ.

Today, the petition was heard before Judge Marikkar of the Court of Appeal, with N. Bandula Karunaratne and M.A.R. representing the Secretary of the Ministry. The Court of Appeal subsequently rescinded the order for the Ministry Secretary’s arrest.

Furthermore, the Court of Appeal has directed the suspension of the case pending in the Horana Magistrate’s Court until the Court of Appeal has considered the petition.
